Preliminary hearing set for teen charged in deaths of family members

A 9 a.m. Dec. 7 preliminary hearing has been set for a Tucumcari teen charged in the death of two family members at their home earlier this week.

Tony Day was charged Tuesday with two open counts of murder, accused of killing his stepmother and her daughter Monday at their home about two miles west of Tucumcari.

State police responding to reports of a homicide in the 4400 block of Quay Road 63 said they found the bodies of Sherry Folts, 49, and her mother, Sue Day, 67.

State police Capt. Ryan Suggs said Day was removed from the residence and taken to state police headquarters where he admitted that he had shot his mother Sue Day and stabbed Folts, his stepsister.

Day remains in the juvenile section of the Quay County Detention Center.

Day was scheduled for a detention hearing Thursday to determine if he should remain in QCDC or be released to the care of family or a state agency.

However his attorney, chief of the New Mexico Public Defender Capital Crimes Unit Jeffrey Buckels, waived the detention hearing
